It is my understanding (and PLEASE correct me if I am mistaken), that 
any ripping of a DVD to create a clip, even if the clip usage is 
considered fair use, is illegal under the Digital Millennium Copyright 
Act, unless one has received an exemption.

We are considering filing for an exemption from the DMCA for faculty in 
foreign language departments using audiovisual materials held in foreign 
language department libraries / Language Media Center libraries (in 
particular, the ripping of f.l. DVD's to create clips). Such an 
exemption was granted in 2006 for film/media studies faculty. It is 
unclear to me whether we could argue that language studies falls into 
that category.

Two questions for the list:

1. Does anyone have any insight on the process? I believe one writes a 
letter to the LOC and then there is a lengthy review process. Has anyone 
considered filing for an exemption before?

2. Would other Language Centers / FL Depts. be willing to write letters 
of support if the Berkeley Language Center took the lead on this? If so, 
rather than clutter the LLTI list with responses, if you could email me 
directly your willingness to sign on, I would greatly appreciate it.
