I think the relevant line in the NYT article is "Such compilations are generally permitted under ''fair use'' provisions of copyright law, but breaking the locks to make the compilations has been illegal."  If an educator is operating within legitimate fair use parameters then the use is probably defensible.

Hi folks,

The NYT reports that the Copyright office has granted exemption to film
professors to copy short snippets of DVDs for instructional purposes. I
wonder if it's limited to film professors, or does it apply to ANY
professors, such as language professors. Here is the NYT article:
