Try this...

1) Select "Color Settings..." from the "Photoshop" menu (in OS X,
possibly the Apple menu in OS 9).
2) Deselect the check box next to "Profile Mismatches" that says "Ask
when opening".
3) Manually open an image with an different profile.
4) When prompted, click the "Don't display this dialog anymore"
checkbox.

Now, try to open the image in Photoshop manually, and with a script.
You can leave out the "showing dialogs" code.  This worked for me.
