We have always asked for and received explicit written permission for 
duplication. Many years ago, we checked out tapes which had to be 
returned to us at the end of the quarter. We then asked for and 
received permission to sell copies of the tapes to enrolled students, 
as long as we sold them only at cost (for us, $1/tape to cover the 
blank tape and staff time).

Now that we have all of our audio served off of the web (again, with 
permission and on password-protected pages), we make free copies of 
tapes for those few students who want them. They provide the blank 
tape.
